Satisfies New York State Legislature & New York City Council Requirements For New York Sexual Harassment Training, as amended in 2018.

It is crucial for New York City employers to familiarize themselves with New York sexual harassment training requirements for both New York State and New York City in order to maintain compliance under both laws.

There are many New York State employment law obligations that employers should be mindful of, including the responsibility of implementing and distributing a written anti-harassment policy as well as well as having all of their employees sign an acknowledgement form that attests that the employee attended the sexual harassment prevention training.

A critical aspect of New York employment laws in New York is that employers are held accountable for the prevention of workplace sexual harassment in cases where the “employer knew or should have known” that the sexual harassment was in fact occurring, and they are expected to take appropriate corrective action to avoid legal repercussion.

Mandatory Written Anti-Sexual Harassment Policy

As of October 09, 2018, all employers in New York State with 15 or more employees are required to provide sexual harassment prevention training to supervisors and employees. New York State employers will receive a model policy published by the New York State Department of Labor and the New York State Division of Human Rights, and are required to follow New York State’s guidelines for New York sexual harassment training.

When administering sexual harassment prevention training for supervisors and employees, legal compliance can only be guaranteed by adherence to the requirements of the Stop Sexual Harassment in NYC Act.

There have been important revisions made to existing New York State and New York City employment law regarding sexual harassment as of 2018. These changes introduced new requirements for employers to follow, mandatory training requirements, and additional protections for employees, contractors, subcontractors, consultants, vendors, and any individual that conducts business or provides a service in the workplace, both in government and private organizations.
